Welcome to the Prestige Club!

These Terms & Conditions (the "Terms") govern the download, access, and use of the Prestige Club mobile application, website, and membership program (collectively, the "App"), together with all related products and services. The App is operated by Gulf Hotels Group.

By purchasing a Prestige Club membership and/or downloading, accessing, or using the App, You confirm that You have read, understood, and agreed to be bound by these Terms.

If You do not agree with all or any part of these Terms, You are expressly prohibited from using the App or any related services. You must immediately discontinue use, uninstall the App and refrain from enrolling in or renewing any Membership.

Your payment for membership and download / continued use of the App constitutes Your acceptance of these Terms, as updated from time to time.

1. DEFINITIONS

Term Definition
Account A unique account created for You to access and use the App.
App The Prestige Club mobile application, website and any related digital platforms operated by Us.
Benefits The discounts, Vouchers, promotions, special room rates, certificates, exclusive promotions and other offers made available to Members under the Membership program, subject always to these Terms, Blackout Dates, and the policies of Partner Hotels and Restaurants.
Blackout Dates The days on which Benefits are not valid, including without limitation Valentine's Day, Formula 1, New Year's Eve and New Year's Day, Eid El-Fitr, Eid El-Adha, Christmas Eve, and Christmas Day (as may be updated by Us from time to time).
Content All source code, databases, functionality, software, website designs, audio, video, text, photographs, documents and graphics within the App.
Customer Service The support team designated by Us to assist Members with inquiries, verification of participating outlets or modifications to Benefits.
Marks The trademarks, service marks, trade names and logos contained in or associated with the App.
Member Any individual who has purchased or enrolled in a Prestige Club membership and/or completed the registration process on the App.
Membership The paid subscription to the Prestige Club program which provides access to Benefits during the Membership Term.
Membership Fees The fees payable by You for enrollment in or renewal of the Membership, as specified in the App or otherwise communicated by Us, which are due in advance and subject to the payment terms set out in these Terms.
Membership Term The fixed period of one (1) year commencing on the date of activation of Your Membership, after which the Membership will expire unless renewed in accordance with these Terms.
Partner Hotels / Restaurants The hotels, restaurants or other outlets that participate in offering Benefits under the Membership program (as may be updated by Us from time to time).
Privacy Policy The Privacy Policy available at here , as may be amended from time to time.
Protected Parties Collectively refers to Us, Partner Hotels/Restaurants, and Our / their respective branches, owners, operators, franchisors, licensors, affiliates, subsidiaries, directors, officers, agents, managers and employees.
Terms This document containing the terms and conditions that govern use of the App, as may be updated from time to time.
Vouchers The digital or physical certificates issued to Members as part of the Membership, which may be redeemed for specific goods, services or discounts, subject to validity periods and restrictions.
Us/ Our/ We / (similar reference) Gulf Hotels Group B.S.C. and its affiliates, subsidiaries, and related entities.
You/ Your/ (similar reference) The person accessing or using the Services, or the company or other legal entity on behalf of which such access or use is being made, as applicable

2. ELIGIBILITY

Membership in the Prestige Club program is open only to individuals who are at least eighteen (18) years of age and who have the legal capacity to enter into binding agreements. By enrolling in the Membership or using the App, You represent and warrant that You meet these requirements.

3. ACCOUNT REGISTRATION

3.1.

To access the Membership and Benefits, You must create and maintain an Account through the App, provide the required personal information (including without limitation Your name, contact details, and payment information), and pay the applicable Membership Fees. The collection and use of such information is governed by Our Privacy Policy

3.2.

You agree to provide accurate, complete, and current information during registration and to update such information as necessary. You must not use a false email address, impersonate another person or entity, or otherwise misrepresent Your identity.

3.3.

Registration requests are subject to Our approval, which may be withheld at Our sole and absolute discretion. We are not obliged to permit any individual to register, and may refuse, suspend or terminate an Account at any time, with or without notice or liability. Each Account is valid for a single individual and is non-transferable.

3.4.

You are solely responsible for maintaining the confidentiality of Your login credentials and for all activities conducted under Your Account.

4. MEMBERSHIP FEES

4.1.

Membership in the Prestige Club program requires payment of the applicable Membership Fees, as set out in the App or otherwise communicated by Us. All Membership Fees must be paid in full and in advance at the time of enrollment or renewal. You authorize Us and Our payment processors to charge the payment method provided by You for all such fees.

4.2.

Membership Fees are strictly non-refundable and non-cancellable.

4.3.

If payment cannot be processed for any reason, We may suspend or terminate Your Membership and access to Benefits without liability to You.

4.4.

You are responsible for any applicable taxes, duties, fees or charges arising from your Membership or use of Benefits, unless expressly stated otherwise.

4.5.

Any incidental charges, surcharges, resort fees or other expenses incurred when using Benefits (including without limitation parking, in-room dining, spa services or gratuities) are the sole responsibility of the Member and cannot be settled by redeeming Benefits or Vouchers.

5. RENEWALS

5.1.

Each Membership is valid for one (1) Membership Term.

5.2.

At the end of the Membership Term, You may renew Your Membership for an additional one-year Membership Term by paying the then-applicable Membership Fees through the App or any other method made available by Us.

5.3.

Unless expressly stated in the App, Memberships will not automatically renew. If auto-renewal is introduced, You will be notified in advance in the App, and renewal fees will be charged to the payment method on file unless You cancel prior to the renewal date.

5.4.

If You do not renew Your Membership prior to the expiry of the Membership Term, Your Membership will automatically lapse and all Benefits, including any unused Vouchers, shall immediately expire without refund, replacement or extension.

6. MEMBERSHIP BENEFITS

6.1.

During the Membership Term, You will be entitled to access and use the Benefits made available under the Membership program, including discounts, Vouchers, promotions and offers, as described in the App or otherwise communicated by Us.

6.2.

All Benefits are subject to:

  1. these Terms;
  2. availability, capacity and operational policies of the relevant Partner Hotels/Restaurants;
  3. any specific terms and conditions applicable to individual Benefits, as determined by Us; and
  4. Any special requests (such as seating, room type, or other preferences) are subject to availability and cannot be guaranteed.

6.3.

We make no guarantees or warranties regarding goods or services provided by third parties under any Voucher, and shall not be liable for any loss, damage or inconvenience arising from their use.

6.4.

Benefits are personal to the Member. They may be used only by the Member and may require presentation of a valid Membership and proof of identification at the time of use,

6.5.

We reserve the right, at Our sole discretion, to modify, suspend, substitute or withdraw any Benefits or Vouchers at any time, without prior notice or liability. Wherever reasonably possible, We will use efforts to keep Members updated on changes, but continued availability of any specific Benefit or Voucher is not guaranteed.

6.6.

The App, Membership and Benefits are provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, regarding their operation, accuracy, reliability, fitness for purpose or non-infringement. To the fullest extent permitted by law, all such warranties are disclaimed.

7. NON-TRANSFERABILITY

7.1.

Memberships and Benefits are personal to the Member and may not be sold, assigned, gifted, transferred, or exchanged for cash or any other value.

7.2.

You must not share or provide access to Your Account, Membership or Benefits to any other person. Any such attempt constitutes a material breach of these Terms and may result in immediate suspension or termination of Your Membership without refund.

8. VOUCHERS

8.1.

Vouchers may only be redeemed in accordance with their stated terms, conditions and validity periods. Certain Vouchers may require advance booking in order to be valid.

8.2.

Vouchers are valid until the expiration date printed on them and shall automatically expire thereafter. Validity will not be extended or reinstated beyond the printed expiration date.

8.3.

Expired, cancelled, lost, unused or forfeited Vouchers will not be replaced, reinstated, extended or refunded under any circumstances. Where cancellation or no-show terms apply to a reservation made using a Voucher, the Voucher will be forfeited even if the service is not used, and no credit or refund will be provided.

8.4.

Vouchers may not be used in conjunction with any other discount, promotion or offer.

9. PARTICIPATING HOTELS & RESTAURANTS

9.1.

The list of Partner Hotels/Restaurants participating in the Membership program is subject to change at any time. We reserve the right, at Our sole discretion, to add, remove, suspend or substitute participating hotels, restaurants or outlets without prior notice.

9.2.

Participating Partner Hotels/Restaurants may cease to honor Benefits, or Benefits and Vouchers may be modified, suspended or withdrawn by Us at any time without prior notice or liability.

9.3.

Wherever reasonably possible, We will use efforts to keep Members updated on changes. Members may verify current participation and Benefits by contacting Customer Service.

9.4.

In the event a specific outlet is outsourced or no longer participates, We may, at Our discretion, suspend or substitute the Benefit with a comparable alternative for the remainder of the Membership Term.

10. RESTRICTIONS ON BENEFIT USE

10.1.

Benefits are valid seven (7) days a week during the Membership Term, excluding Blackout Dates (as may be updated by Us from time to time), unless otherwise specified.

10.2.

Benefits may not be combined with any other discounts, promotions or special offers.

11. USER RESPONSIBILITIES

11.1.

You must use the App, Membership and Benefits only in a lawful manner and in accordance with these Terms. Without limiting the generality of the foregoing, You must not:

  1. misuse the App or Benefits in any unlawful, fraudulent or abusive manner;
  2. attempt to gain unauthorized access to, interfere with, damage or disrupt the App, its servers or its security features;
  3. introduce any viruses, malware or other harmful technology; or
  4. use the App or Benefits in a way that infringes the rights of any third party.

12. SUSPENSION AND TERMINATION

12.1.

These Terms remain in full force and effect for as long as You hold a Membership or use the App or Benefits.

12.2.

We may, in Our sole discretion, suspend or terminate Your Account or Membership, restrict Your access to the App, and/or withdraw Your Benefits at any time, with or without notice or liability, including (without limitation) if:

  1. You fail to pay the Membership Fees when due;
  2. You breach any of these Terms, including misuse of the App, Vouchers, or Benefits;
  3. You provide false, incomplete, or misleading information during registration or thereafter;
  4. You share, transfer, or otherwise misuse Your Account or Membership; or
  5. We are required to do so by law, regulation, or governmental authority.

12.3.

For the avoidance of doubt, We also reserve the right, in Our sole discretion, to deny, suspend, or terminate access to the App, Membership, or Benefits to any person at any time, for any reason or for no reason at all.

12.4.

Upon termination or suspension of Your Membership:

  1. You will immediately lose access to the Membership and all Benefits, including unused Vouchers;
  2. no refunds, replacements, or extensions will be provided for any portion of the Membership Term; and
  3. We shall have no liability to You in connection with such suspension or termination, except as expressly required by applicable law.

12.5.

You may discontinue Your Membership at any time by uninstalling the App and ceasing use of the Services. However, Membership Fees are strictly non-refundable and non-cancellable.

12.6.

If We terminate or suspend Your Account, You are prohibited from registering or creating a new Account under Your name, a different name or through any other person, device or means, without Our prior written consent.

13. MONITORING, CORRECTIONS AND SERVICE INTERRUPTIONS

13.1.

There may be information on the App or in relation to the Benefits that contains typographical errors, inaccuracies or omissions, including descriptions, pricing, availability or other details. We reserve the right to correct any such errors, inaccuracies or omissions and to update the information at any time without prior notice.

13.2.

We may monitor Membership accounts and activity at any time to ensure compliance with these Terms. We reserve the right to adjust, revoke or cancel Benefits, Vouchers or Membership privileges that were issued or obtained in error, through misuse, or in violation of these Terms.

13.3.

We reserve the right to change, suspend or discontinue the App or any Benefits at any time, with or without notice. We do not guarantee that the App or Benefits will always be available or uninterrupted, and We shall not be liable for any unavailability, interruption, delay or error.

14. INTELLECTUAL PROPERTY

14.1.

The App, including without limitation all Content, Marks, designs, logos, graphics, images, audio, video, software, databases and other materials, are owned or licensed by Us and are protected by copyright, trademark, unfair competition laws and other intellectual property rights, whether registered or unregistered, in Bahrain and internationally.

14.2.

Subject to Your compliance with these Terms, We grant You a limited, non-exclusive, non-transferable and revocable license to download, access and use the App solely for Your personal, non-commercial use during the Membership Term. All Content and Marks are provided "AS IS."

14.3.

Except as expressly permitted by these Terms, You must not:

  1. copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any part of the App, Content or Marks;
  2. modify, adapt, translate or create derivative works from the App or Content;
  3. decompile, reverse engineer or disassemble any part of the App;
  4. remove or alter any copyright, trademark, or proprietary rights notices; or
  5. use Our Marks, logos, or trade names without Our prior written permission.

14.4.

All rights not expressly granted to You in these Terms are reserved by Us and Our licensors.

15. LIMITATION OF LIABILITY

15.1.

While We use reasonable efforts to ensure the App and Membership Benefits operate as described, We make no warranties or representations, express or implied, regarding the accuracy, availability, reliability or uninterrupted operation of the App or any Benefits.

15.2.

To the maximum extent permitted by law, Protected Parties shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including without limitation loss of profits, data, goodwill, opportunity or savings, arising out of or in connection with Your access to or use of the App, the Membership, or any Benefits, whether based in contract, tort, negligence or otherwise, even if advised of the possibility of such damages.

15.3.

Without limiting the generality of Clause 15.2, the total liability of any Protected Party to You for any claim arising out of or relating to the Membership, Benefits, or these Terms shall not exceed the amount of Membership Fees actually paid by You for the current Membership Term.

15.4.

Partner Hotels / Restaurants and third-party providers providing Benefits are independent contractors and not agents or employees of Us. We are not liable or responsible for any acts, errors, omissions, representations, warranties, breaches or negligence of such third parties, nor for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Any issues with such services must be taken up directly with the relevant third party.

16. DATA PROTECTION AND PRIVACY

16.1.

The collection, use and processing of Your personal information in connection with the App and Membership are governed by Our Privacy Policy, available at [INSERT LINK], as may be amended from time to time.

16.2.

By registering for a Membership or using the App, You acknowledge and agree to the terms of the Privacy Policy, and consent to the collection, use and disclosure of Your personal information as described therein.

16.3.

You are responsible for ensuring that the personal information provided to Us is accurate, complete and current.

16.4.

We may share certain personal information with third-party service providers as described in the Privacy Policy. The Protected Parties shall not be liable for the acts or omissions of such third parties, except as required by applicable law.

17. USER REPRESENTATIONS

17.1.

By using the App, You represent and warrant that:

  1. You have the legal capacity and You agree to comply with these Terms;
  2. You are not a minor in the jurisdiction in which You reside;
  3. You will not access the App through automated or non-human means, whether through a bot, script or otherwise;
  4. You will not use the App for any illegal or unauthorized purpose; and
  5. Your participation in the Membership program and / or use of the App will not violate any applicable law or regulation applicable to You.

17.2.

If You provide any information that is untrue, inaccurate, not current, or incomplete, We reserve the right to suspend or terminate Your Account, refuse or withdraw Your Membership, and deny access to any Benefits or Vouchers, in whole or in part, at Our sole discretion.

18. OUR RIGHTS

18.1.

We reserve the right, but not the obligation, to:

  1. monitor the App and Services for compliance with these Terms;
  2. take legal or administrative action against any Member who violates these Terms or applicable law, including reporting to authorities where appropriate;
  3. restrict, suspend, or disable access to any Account, Content or Benefits that We consider, in Our sole discretion, to be unlawful, in breach of these Terms or harmful to the App; and / or
  4. manage the App in a manner designed to protect Our rights, property and systems, and to maintain proper functionality.

18.2.

These actions may be taken at any time, in Our sole discretion, without notice or liability to You.

19. CROSS BORDER ISSUE

Certain Benefits may be redeemed at Partner Hotels / Restaurants located outside the Kingdom of Bahrain. Members are solely responsible for complying with all applicable travel requirements, including valid passports, visas, health regulations, and any local laws. We are not responsible for any denial of entry, inability to travel, or loss of Benefits arising from a Member's failure to meet such requirements.

20. GEOGRAPHICAL RESTRICTIONS

The App may be accessed worldwide. However, it is not intended for use in any country or jurisdiction where such use would be unlawful or would require Us to obtain additional licenses or registrations. If You access or use the App from outside the Kingdom of Bahrain, You are responsible for complying with all applicable local laws. If local laws prohibit use of the App or Services, You must not use them.

21. INDEMNITY

You agree to indemnify, defend, and hold harmless Us, Partner Hotels/Restaurants, and the Protected Parties from and against any claims, losses, liabilities, damages, costs or expenses (including reasonable legal fees) arising out of or in connection with: (a) Your misuse of the App, Membership or Benefits; (b) Your breach of these Terms; or (c) Your violation of any applicable law or third-party rights.

22. NOTICES AND COMMUNICATIONS

Any notices or communication under the Terms, Privacy Policy or the Services may be delivered to you electronically as a notification in the App, via email and such notification shall be deemed by Us to be appropriate. For clarity, any in-App notifications delivered through the App will be deemed valid notice, even if You do not access or read them.

Notices or communications to us can be delivered electronically at ADD DETAILS.

By creating a Membership or accessing and using the App, You consent to receive electronic communications from Us. You agree that all agreements, notices, disclosures and other communications provided electronically (including via App notifications or email) satisfy any legal requirement that such communications be in writing. You agree to the use of electronic signatures, contracts, orders and records and to the electronic delivery of notices, policies and transaction records. You waive any rights under applicable laws that require original (non-electronic) signatures, paper records or non-electronic methods of payment or credit.

23. AMENDMENTS

23.1.

We reserve the right, at Our sole discretion, to amend, update or modify these Terms, the Membership program, or the Benefits at any time and for any reason, without prior notice.

23.2.

Any amendments will be effective upon posting in the App or on Our website, unless otherwise stated. Wherever reasonably possible, We will notify Members of material changes through the App (via push notification), email or other appropriate communication channels.

23.3.

Your continued use of the App or Membership following any amendment constitutes Your acceptance of the updated Terms. If You do not agree to the updated Terms, You must immediately discontinue use of the App and Membership. In such cases, Membership Fees remain strictly non-refundable and non-cancellable.

24. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms, the Membership and any dispute, claim or controversy arising out of or in connection with them, or with the App or Benefits, shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain. The courts of the Kingdom of Bahrain shall have exclusive jurisdiction to settle any such dispute, claim or controversy.

25. MISCELLANEOUS

25.1.

These Terms constitute the entire agreement between You and Us regarding the Membership and supersede any prior agreements or understandings.

25.2.

Any delay or failure by Us to enforce any provision of these Terms shall not be deemed a waiver of that or any other provision.

25.3.

We may assign or transfer Our rights and obligations under these Terms without restriction. You may not assign or transfer Your Membership without Our prior written consent.

25.4.

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be deemed severable and the remainder shall continue in full force and effect.

25.5.

Interpretation of these Terms, eligibility for Membership and determination of any disputes regarding Benefits shall rest solely with Gulf Hotels Group.
