Rincon Beach Plus Membership Benefits

Use of the Rincon Beach Plus Membership Card constitutes acceptance of the conditions listed herein:

1. Membership Card: The Rincon Beach Plus Membership Card is the property of the issuing agent and must be returned upon request. Membership privileges will only be honored upon presentation of a valid Membership Card and only through the date embossed on the Membership Card. Membership Card has no cash value.

2. Dining Benefits: Upon presentation of a valid Membership Card, each Rincon Beach Plus member will be provided a complimentary meal when accompanied by one or more dining guests, provided at least one meal is purchased. The complimentary portion of your bill is determined by dividing the total food bill (excluding alcoholic beverages, taxes and gratuities) by the number of people in your dining party, and subtracting that
amount from the original bill. Limit one (1) card per table. Dining benefits are non-transferable. Your card will be honored at the RINCON BEACH RESORT at Brasas Restaurant for breakfast, lunch and dinner. Members will also recieve a 15% discount on the food portion of the total bill for lunch only at Pelican Bar & Grill and 15% discount from the the regular prices for the Tapas Menu at Boutique Wine Bar. RINCON BEACH RESORT reserves the right to change hours of operation without prior notice. Not valid with any other discounts or promotions.

3. Dining Restrictions: Dining privileges will not be honored at the RINCON BEACH RESORT on New Year's Day, Valentine’s Day, Mother’s Day, Thanksgiving Day, or Christmas Eve, Christmas Day, Christmas Parties and New Year’s Eve. Other blackout dates may apply. Please contact the RINCON BEACH RESORT to confirm the date each
holiday is observed. Not valid with any other discounts or promotions.

4. Guest Room Benefits:
A) Each Rincon Beach Plus member is entitled to a Preferred Membership Rate. In the event that a lower nonrestrictive room rate is available for the dates booked, member shall be entitled to receive a 10-30% discount off the best publicly available rate, for no more than three (3) rooms per reservation. Subject to availability. A valid membership number must be presented in order to redeem benefit, however, member need not be present at his/her guest check-in to qualify for the above rates. Transferable.
B) Each Rincon Beach Plus member is entitled to a complimentary upgrade to next available room category when on the preferred membership room rate. Subject to availability at check in. Does not apply to suites or club floor. All rates base on Rack Rates. Black out dates may apply. Non-transferable.
C) Each Rincon Beach Plus member receives one (1) certificate valid for a complimentary second consecutive night's stay providing the previous night is paid for. This non-transferable benefit is valid based on advance reservations, space availability and restrictions on allocated rooms. Subject to availability. Not valid in conjunction
with other offers or coupons. All rates base on Rack Rates. Black out dates may apply. In order to redeem this certificate, member must contact the RINCON BEACH RESORT directly at (787) 589-9000.
D) Each Rincon Beach Plus member receives one (1) "3 Nights for 2" certificates valid for a complimentary third consecutive night's stay providing the previous two (2) nights are paid at rack rate. Advance reservations required. Not valid in conjunction with other offers or coupons. All rates base on Rack Rates. Black out dates may apply. Transferable.
E) Each Rincon Beach Plus member will receive two (2) certificates valid for 50% discount on the rack rate for one (1) night between Sunday and Thursday at either Deluxe Ocean View room, Junior Suite or Villa categories. Valid for one (1) night stay with a maximum stay of three (3) consecutive nights. Advance reservations required. Not valid in conjunction with other offers or coupons. All rates base on Rack Rates. Black out dates may apply. Transferable.
F) Early check-in and check-out time, not to exceed four (4) hours of posted time if available. Non-transferable.

5. Guest Room Restrictions: Guest room benefits are valid for standard guest rooms only (except for upgrades), based on advance reservations, subject to space availability and restrictions on allocated rooms. Not valid for bookings through travel agents, group or block bookings, or in conjunction with corporate rates. Membership number must
be provided upon time of advance reservation for member and/or guest. Certificate and Membership Card must be presented in order to redeem benefits. Where benefits are “transferable”, member and Membership Card need not be present at time of guest check-in to qualify for the above benefits.

6. Happy Hour Hors d'oeurves Party Benefit: Each Rincon Beach Plus member receives one (1) certificate valid for one (1) complimentary one (1) hour Happy Hour Hors d'oeurves Party (excluding beverages, taxes and gratuities) in lounge for a minimum of 15 people and up to 25 people maximum. Includes a reserved party space and hotel selected hors d’oeuvres. Reservations must be made at least one (1) week in advance. Subject to
availability. Must purchase at least two (2) alcoholic drinks per person or a minimum amount purchase in alcoholic beverages of $200.00 for 15 people or $300.00 for 25 people. Non-transferable.

7. Junior Suite Benefit: Each Rincon Beach Plus member receives one (1) certificate valid for one (1) complimentary junior suite when booking a group of ten (10) or more paying rooms. group reservation must be for a minimum of two (2) nights and has to be reserved directly with the hotel’s sales department. Subject to space availability. Junior suite will be provided for the duration of the stay as a group. One (1) certificate only per group booking. Transferable.

8. Kayak Benefit: Each Rincon Beach Plus member receives one (1) certificate valid for one (1) complimentary use of a kayak or paddle boat for one (1) hour. Non-transferable.

9. Pool Benefit: Each Rincon Beach Plus member receives two (2) certificates each valid for use of the swimming pool for up to five (5) people from Sunday to Thursday. Subject to availability and previous reservation and hotel approval with at least one (1) week in advance. Certain restrictions may apply including a Pool Towel Fee and Deposit. Transferable.

10. Referral Card Incentive: Upon submitting five (5) names of friends or colleagues to be solicited for potential memberships, you will receive one (1) certificate valid for complimentary bottle of house wine (pursuant to Puerto Rico liquor laws) to be enjoyed while dining at Brasas Restaurant with at least three (3) other people. This non-transferable certificate is not valid for room service. Member must be 21 years of age. Bottle may not be removed from restaurant.

11. Certificates: The RINCON BEACH RESORT must be notified as to the use of certificates at time of advance reservation. Certificates must be presented upon arrival in order to redeem benefits. Valid only through the date embossed on Membership Card.

12. Other Promotional Discounts: Rincon Beach Plus membership privileges may not be used in conjunction with any other discount programs or promotions, including corporate rates.

13. Lost/Stolen Cards and Certificates: All lost or stolen certificates will not be replaced. Lost or stolen Membership Cards must be reported. A processing fee of twenty dollars ($20.00) will be charged for replacement of Membership Cards. If your card is lost or stolen, a replacement card will be issued with a new membership number and the same expiration date as the previously issued card.

14. Cancellations: Cancellations will be honored up to ten (10) days from the date of purchase, but such termination will not be effective until all cards and membership materials have been returned unused to the Rincon Beach Plus Membership Processing Center, 1045 Howe Street, Suite 925, Vancouver, BC, Canada, V6Z 2A9. No refund will be payable until such action has been taken by the member. Please note that the five dollar ($5.00) shipping and handling fee will not be refunded in the case of a cancellation.

15. Limitation of Liability: In no event will the marketing agent of Rincon Beach Plus be liable for any indirect, special, or consequential damages without limiting the generality thereof, including any loss, cost or damage to or suffered by Rincon Beach Plus members or others, arising from defects, negligence, delays, failure of performance or non-performance. Including all claims, demands, obligations, liabilities, indebtedness, breaches
of contract, breaches of duty or of any relationship, liability for acts, omissions, misfeasance, malfeasance, damages of every type, nature, or kind suffered by the Rincon Beach Plus member or to others, resulting from the action, or inaction of the Hotel or its agents or employees.



TERMS & CONDITIONS


(i) Acceptance: Use of the membership card constitutes
acceptance of the terms and conditions listed herein.

(ii)
Membership Card:
The membership card is the property of the issuing
agent and must be returned upon request; valid until the expiry date featured on
the membership card, which shall be one year after initial purchase date; has no
cash value and does not guarantee any dining reservation.

(iii)
Membership Benefit Conditions:
All benefits are subject to
availability; valid seven days a week, unless otherwise specified,
excluding Black Out Dates below; valid until the expiry date
featured on the membership card and may not be used in conjunction with any
other discount or promotional offer. Membership discounts exclude applicable
taxes, service charges and gratuities.

(iv) Black Out
Dates:
All benefits shall not be valid on the following dates: New
Year’s Eve, Christmas Day, Christmas Eve, Valentine’s Day and Easter
Day.

(v) Transferable and Non-transferable Benefits:
A.
Transferable:
Benefits may be used by the Member or by a Member’s
guest. The Member/Membership Card need not be present at time of guests’ use of
the benefit.
B. Non-transferable: Benefits may be used only
by the Member and upon presentation of their valid Membership Card. Proof of
identification may be required by Hotel.

(vi)
Certificates:
Only one (1) set of certificates per Member per
membership term. Hotels must be notified of the intended use of certificates at
the time of advance reservation. Certificates are valid seven (7) days a week ,
unless otherwise specified, up to the expiration date printed on said
certificates and such validity will not be extended; may not be used in
conjunction with any other discount or promotional offer; and have no cash
value. Cash/Thank you Certificates: Excluding applicable taxes, service
charges and gratuities.

(vii) Modification (Hotel/Restaurant
& Benefit Changes):
At the time of going to print, all hotels
detailed in the membership collateral are participating hotel(s) within the
membership program. Participating hotel(s)/restaurants may cease to honor
benefits without prior notice. Benefits may also be subject to change without
prior notice. Wherever possible, Members will be kept updated on all such
modifications. Members can also verify restaurant participation & benefits
by calling Customer Service. Membership Program marketing agent declines any
responsibility for any such modification.

(viii) Currency
Exchange:
All amounts listed in US$ may be charged/calculated in local
currency using current rates of exchange.

(ix) Lost/Stolen
Membership Materials:
All lost or stolen certificates will not be
replaced
. Lost or stolen membership cards must be reported to Customer
Service. A processing fee of US$ 20.00 will be charged for each replacement
membership card, which will be issued with the same expiration date as the
previously issued card.

(x) Cancellations: Cancellation
of Membership will be honored up to ten (10) days from the date of issue, but no
refund will be issued until the membership card and all certificates have been
returned unused to a Customer Service Office. Refund amount will be excluding
shipping & handling charges
.

(xi) Limitation of
Liability:
In no event shall the owners, operators, franchisors or
licensors of any hotel that may accept the benefits of membership herein, or any
of their affiliated or subsidiary companies, or their directors, agents,
managers, or employees, or the proprietor or the marketing agent of the
Membership Program (hereinafter collectively “Protected Parties”) be liable for
any indirect, special or consequential damages; and without limiting the
generality thereof, including any loss, cost or damage to, or suffered by, the
Member or others, arising from defects, negligence, delays, failure of
performance or non-performance, including all claims, demands, obligations,
liabilities, indebtedness, breaches of contract, breaches of duty or of any
relationship, liability for acts, omissions, misfeasance, malfeasance, damages
of every type, nature or kind suffered by Members or others, resulting from the
action, or inaction of the hotel or its agents or employees in connection with
the Benefits provided to Member herein. In the event of a breach of any of the
provisions hereof by any Protected Party, the extent of any liability of any
such Protected Party shall be limited to the amounts paid by Member as a
subscription for membership in the marketing program.
