InterContinental Hotels Group Saudi Arabia Privilege Club Membership Agreement

Use of the membership card and/or any of the certificates constitutes acceptance of the terms and conditions listed herein:

1. Dining Benefit (Non-transferable): Members shall receive a twenty-five percent (25%) discount at participating restaurants, for breakfast, brunch, lunch and dinner for up to a maximum group size of twelve (12) people dining.

Conditions: Only one card per table • Membership Card must be presented at time of dining in order to receive discount • All food and beverage must be purchased during the restaurants' operating hours, and ordered from the restaurants' regular menu, including any and all special menus, attachments, or "clip-ons" • The discount shall not be applied to (a) applicable taxes, service charges and gratuities; (b) orders made off-premises, functions or through room service; (c) discounted dining specials or hotel promotions independent of the Privilege Club program; (d) all beverages and (e) meals taken as part of bed & breakfast, half-board or full-board package rates.

2. Preferred Room Rate (Transferable): Member shall receive a ten percent (10%) discount off the best flex rate • Valid at all participating hotels/resorts.

Conditions: Valid for single or double occupancy • Not valid for bookings made through travel agents or for group or block bookings • Reservations must be made in advance and are subject to space availability restrictions • Membership number must be provided at time of advance reservation for Member and/or guest.

3. Beverage Benefit (Non-transferable): Twenty percent (20%) discount on all beverages for up to a maximum group size of twelve (12) people • Valid in all participating restaurants • Discount shall not apply to applicable taxes, service charges and gratuities.

4. Lobby and Lounge Benefit (Non-transferable): Twenty five percent (25%) discount on food for up to a maximum group size of twelve (12) people ● Valid in all participating lounges ● Discount shall not apply to (a) applicable taxes, service charges and gratuities; (b) all beverages.

5. Pastry Shop Benefit (Non-transferable): Fifteen percent (15%) discount on all take-away cakes, pastries and breads ● Discount will not apply to food and beverage retail items offered in the Pastry Shop ● Discount will increase to thirty percent (30%) after 8.00 pm ● Not valid for pre-ordered items.

6. CLUBHOTEL Benefit (Non-transferable): Members shall receive a variety of benefits at participating hotels outside the Kingdom of Saudi Arabia, upon presenting their CLUBHOTEL membership card • CLUBHOTEL membership provides exceptional dining and room benefits at over 700 luxurious hotels in 50 countries and over 420 cities around the world • Visit www.clubhotel.com for more information

7. Certificate Booklet: Each member will receive one (1) set of Privilege Club Certificates, containing the following certificates for use at hotel/resort as specified on each certificate, terms & conditions as printed on each certificate:

a. 2 x SAR 250 InterContinental Cash Certificate (Transferable): Two (2) Cash Certificates to the value of two hundred fifty Saudi Arabian Riyals (SAR 250) each, for full or part payment of food and beverage or preferred room rate, valid at any participating InterContinental hotel/resort in Saudi Arabia.

b. 1 x SAR 250 Crowne Plaza Cash Certificate (Transferable): One (1) Cash Certificate to the value of two hundred fifty Saudi Arabian Riyals (SAR 250), for full or part payment of food and beverage or preferred room rate, valid at any participating Crowne Plaza hotel/resort in Saudi Arabia.

c. 1 x SAR 180 Holiday Inn Cash Certificate (Transferable): One (1) Cash Certificate to the value of one hundred eighty Saudi Arabian Riyals (SAR 180), for full or part payment of food and beverage or preferred room rate, valid at any participating Holiday Inn hotel/resort in Saudi Arabia.

d. 2 x Soft Drinks Certificate (Transferable): Two (2) certificates for a complimentary one liter (1 l) carafe of Soft Drinks, when there are two (2) or more people dining, valid at any participating hotel/resort in Saudi Arabia.

e. 1 x Friday Brunch Certificate (Transferable): One (1) certificate for a fifty percent (50%) discount on a Friday Brunch, when a minimum of four (4) to a maximum of ten (10) people are dining, valid at any participating hotel/resort in Saudi Arabia.

f. 1 x Birthday Certificate (Non-transferable): One (1) certificate for a complimentary two pound (2 lb)/one kilogram (1 kg) birthday cake when two (2) or more people are dining, valid at any participating hotel/resort in Saudi Arabia.

g. 1 x Anniversary Certificate (Non-transferable): One (1) certificate for a complimentary two pound (2 lb)/one kilogram (1 kg) anniversary cake when two (2) or more people are dining, valid at any participating hotel/resort in Saudi Arabia.

h. 2 x Wedding Banquet Certificate (Transferable): Two (2) certificates for a fifteen percent (15%) discount, up to a maximum of one thousand eight hundred fifty Saudi Arabian Riyals (SAR 1850), on any wedding banquet or catering function, valid at any participating hotel/resort in Saudi Arabia.

i. 2 x Banquet Certificate (Transferable): Two (2) certificates for one (1) complimentary dinner for two (2) people on a minimum spend of 10,000 SAR OR one (1) complimentary dinner for four (4) people on a minimum spend of 20,000 SAR OR one (1) complimentary ‘Dine & Stay’ for two (2) people on a minimum spend of 50,000 SAR on the purchase of any conference, banqueting or catering function that is held and paid for, valid at any participating hotel/resort in Saudi Arabia.

j. 3 x Complimentary Upgrade Certificate (Transferable): Three (3) certificates for a complimentary upgrade to the next best available room category for a stay of up to three (3) consecutive nights, valid at any participating hotel/resort in Saudi Arabia.

k. 2 x “3 nights for 2” Certificate (Transferable): Two (2) certificates to get the third night free, when the first two (2) nights are fully paid, at members preferred rate, valid at any participating hotel/resort in Saudi Arabia.

l. 3 x Buy One Get One Free Certificate (Transferable): Three (3) certificates to enjoy the second (2nd) consecutive night free, when paying for the first (1st) night at the member’s preferred room rate ● One (1) certificate each valid at any participating InterContinental, Crowne Plaza and Holiday Inn hotel/resort.

m. 1 x Early Check-in/Late Check-out Certificate (Transferable): One (1) certificate for an early check-in at 10.00 am and a late check-out at 3.00 pm, valid at any participating hotel/resort in Saudi Arabia.

n. 2 x Health Club/Outdoor Pool Certificate (Non-transferable): Two (2) certificates for a complimentary day visit pass to enjoy the hotel’s Health Club and Outdoor Pool facilities for two (2) people, valid at any participating hotel/resort in Saudi Arabia.

o. 2 x Stay Fit Certificate (Transferable): Two (2) certificates for a twenty five percent (25%) discount on the annual Health Club Membership Fee for up to two (2) people, valid at any participating hotel/resort in Saudi Arabia.

p. 8 x Laundry Certificate (Transferable): Eight (8) certificates for a thirty percent (30%) discount on all laundry and dry cleaning services when a resident guest at the hotel, valid at participating any hotel/resort in Saudi Arabia.

8. Referral Benefit (Non-transferable): Upon submission of the names of a minimum of five friends or colleagues to be solicited for potential membership, Member shall receive, for each such friend or colleague who purchases a membership one (1) complimentary brunch buffet for two (2) people, valid at any participating Crowne Plaza hotel/resort in Saudi Arabia ● Does not include beverages, applicable taxes, service charges and gratuities ● A maximum of two (2) certificates per Member per membership term.

9. Renewal Benefit: Upon renewal of membership, Member shall receive:

a. Complimentary Spouse Membership Card (Non-Transferable): One (1) complimentary Spouse Membership Card. Spouse Members receive the same Benefits as Members but excluding any and all certificates i.e. valid only for Member Benefits associated directly with the membership card. With the exception of countries where it is customary for spouses not to take on the same family name, Spouse Members must have the same family name as the Member

b. 1 x Complimentary Brunch Certificate (Non-Transferable): One (1) certificate to enjoy a complimentary brunch buffet for two (2) people, valid at any participating InterContinental hotel/resort in Saudi Arabia ● Does not include beverages, applicable taxes, service charges and gratuities ● Not valid at The Fishmarket, InterContinental Jeddah

TERMS & CONDITIONS

(i) Acceptance: Use of the membership card constitutes acceptance of the terms and conditions listed herein.

(ii) Membership Card: The membership card is the property of the issuing agent and must be returned upon request; valid until the expiry date featured on the membership card, which shall be one year after initial purchase date; has no cash value and does not guarantee any dining reservation.

(iii) Membership Benefit Conditions: All benefits are subject to availability; valid seven days a week, unless otherwise specified, excluding Black Out Dates below; valid until the expiry date featured on the membership card and may not be used in conjunction with any other promotional offers, discounts, loyalty programs, coupons or vouchers. Membership discounts exclude applicable taxes, service charges and gratuities.

(iv) Black Out Dates: All room benefits/certificates shall not be valid during the Hajj season in participating hotels in Jeddah, Madinah and Makkah.

(v) Transferable and Non-Transferable Benefits:
A. Transferable: Benefits may be used by the Member or by a Member’s guest. The Member/ Membership Card need not be present at time of guests’ use of the benefit.
B. Non-Transferable: Benefits may be used only by the Member and upon presentation of their valid Membership Card. Proof of identification may be required by Hotel.

(vi) Certificates: Only one (1) set of certificates per Member per membership term. Hotels must be notified of the intended use of certificates at the time of advance reservation. Certificates are valid seven (7) days a week , unless otherwise specified, up to the expiration date printed on said certificates and such validity will not be extended; may not be used in conjunction with any other promotional offers, discounts, loyalty programs, coupons or vouchers; and have no cash value. Cash Certificates: Excluding applicable taxes, service charges and gratuities.

(vii) Modification (Hotel/Restaurant & Benefit Changes): At the time of going to print, all hotels detailed in the membership collateral are participating hotels within the membership program. Participating hotels/restaurants may cease to honor benefits without prior notice. Benefits may also be subject to change without prior notice. Wherever possible, Members will be kept updated on all such modifications. Members can also verify restaurant participation & benefits by calling Customer Services. Membership Program marketing agent declines any responsibility for any such modification.

(viii) Currency Exchange: All amounts listed in US$ may be charged/calculated in local currency using current rates of exchange.

(ix) Lost/Stolen Membership Materials: All lost or stolen certificates will not be replaced. Lost or stolen membership cards must be reported to Customer Services. A processing fee of US$ 20.00 will be charged for each replacement membership card, which will be issued with the same expiration date as the previously issued card.

(x) Cancellations: Cancellation of Membership will be honored up to ten (10) days from the date of issue, but no refund will be issued until the membership card and all certificates have been returned unused to a Customer Services Office. Refund amount will be excluding shipping & handling charges.

(xi) Limitation of Liability: In no event shall the owners, operators, franchisors or licensors of any hotel that may accept the benefits of membership herein, or any of their affiliated or subsidiary companies, or their directors, agents, managers, or employees, or the proprietor or the marketing agent of the Membership Program (hereinafter collectively “Protected Parties”) be liable for any indirect, special or consequential damages; and without limiting the generality thereof, including any loss, cost or damage to, or suffered by, the Member or others, arising from defects, negligence, delays, failure of performance or non-performance, including all claims, demands, obligations, liabilities, indebtedness, breaches of contract, breaches of duty or of any relationship, liability for acts, omissions, misfeasance, malfeasance, damages of every type, nature or kind suffered by Members or others, resulting from the action, or inaction of the hotel or its agents or employees in connection with the Benefits provided to Member herein. In the event of a breach of any of the provisions hereof by any Protected Party, the extent of any liability of any such Protected Party shall be limited to the amounts paid by Member as a subscription for membership in the marketing program.
