Crowne Plaza Dubai: Privilege Club Membership Agreement

Use of the membership card and/or any of the certificates constitutes acceptance of the terms and conditions listed herein:

1. Dining Benefit (Non-Transferable): Members shall receive a twenty five percent (25%) discount at participating restaurants, as specified on the Privilege Club web-site, for breakfast, brunch, lunch and dinner for up to a maximum group size of twelve (12) people dining.
Conditions: Only one card per table • Membership Card must be presented at time of dining in order to receive discount • All food and beverage must be purchased during the restaurant’s operating hours, and ordered from the restaurant’s regular menu, including any and all special menus, attachments, or "clip-ons" • The discount shall not be applied to (a) applicable taxes, service charges and gratuities; (b) orders made off-premises, functions or through room service; (c) discounted dining specials or hotel promotions independent of the Privilege Club program; (d) all beverages and (e) meals taken as part of bed & breakfast, half-board or full-board package rates

2. Preferred Room Rate (Transferable): Member shall receive a ten percent (10%) discount off the best flex rate on week days and a fifteen percent (15%) discount off the best flex rate during weekends (Thursday, Friday, and Saturday)

Members shall be entitled to a twenty percent (20%) discount off the best flexible rate and best flexible breakfast rate • Rate excludes service charges and taxes • Discount is applicable on all room types • Limited Offer valid until 31 December 2011 only • Valid only at InterContinental Abu Dhabi, Crowne Plaza Abu Dhabi, Crowne Plaza Abu Dhabi Yas Island, all IHG participating hotels in the Dubai Festival City complex and Crowne Plaza Dubai

Conditions: Valid for single or double occupancy • Not valid for bookings made through travel agents or for group or block bookings • Reservations must be made in advance and are subject to space availability restrictions • Membership number must be provided at time of advance reservation for Member and/or guest • Rate is bookable upon availability

3. Beverage Benefit (Non-transferable): Member shall receive a twenty percent (20%) discount on all alcoholic and non-alcoholic beverages for up to a maximum group size of twelve (12) people • Valid in all participating restaurants, as specified on the Privilege Club web-site • Discount shall not apply a) to applicable taxes, service charges and gratuities b) during “Happy Hour” at Trader Vic’s and Harvester’s Pub

4. Pastry Shop Benefit (Non-transferable): Member shall receive a twenty five percent (25%) discount on all take-away cakes, pastries and breads purchased at Cappuccino’s • Discount will not apply to food and beverage retail items offered at the Cappuccino’s • Discount will increase to fifty percent (50%) after 6.00 pm; not valid for pre-ordered items.

5. Stay Fit Benefit (Non-transferable): Member shall receive a thirty percent (30%) discount on the annual membership fee for up to two (2) people at Hotel’s Health Club.
Conditions: Discount can be applied for new or renewal Health Club annual Membership fee • Subject to approval from Health Club Management.

6. 7. Certificate Booklet: Each member will receive one (1) set of Privilege Club Certificates, containing the following certificates for use at Crowne Plaza Dubai, terms & conditions as printed on each certificate:
a. 4x AED 100 Cash Certificate (Transferable): Four (4) Cash Certificates to the value of one hundred Dirhams (AED 100) each, for full or part payment of food and beverage • Can be used up to a maximum spend of three hundred Dirhams (AED 300) per visit
b. 8x AED 50 Cash Certificate (Transferable): Eight (8) Cash Certificates to the value of fifty Dirhams (AED 50) each, for full or part payment of food and beverage • Can be used up to a maximum spend of three hundred Dirhams (AED 300) per visit
c. 8 x AED 50 Cash Certificate (Transferable): Eight (8) Cash Certificates to the value of fifty Dirhams (AED 50) each, for full or part payment of food and beverage • Can be used up to a maximum spend of three hundred Dirhams (AED 300) per visit •Two (2) certificates each valid at Al Dana Restaurant, The Western Steakhouse, Sakura Japanese Restaurant and Oscar’s Vine Society
Double Value Lunch: Face value of this certificate may be DOUBLED if redeemed during Lunch at Sakura Japanese Restaurant, Oscar’s Vine Society or Western Steakhouse • Maximum face value of hundred Dirhams (AED 100) may be redeemed, giving you a doubled value of two hundred Dirhams (AED 200) • A maximum of two (2) fifty Dirhams (AED 50) certificate may be used per visit for this offer
d. 1 x AED 100 Accommodation Cash Certificate (Transferable): One (1) certificate to the value of one hundred Dirhams (AED 100) for full or part payment of accommodation • Valid between 15 September and 15 May ONLY • Valid in conjunction with the applicable best flex rate only

8. Limited Special Offer: Each member will receive the following Privilege Club certificate, terms & conditions as printed on each certificate ♦ Limited Offer valid until 31 December 2011 only

i. 1 x Complimentary MAIN COURSE Certificate (Non-transferable): One (1) certificate for one complimentary MAIN COURSE when a MAIN COURSE of equal or greater value is purchased ♦ Valid only at Sakura Japanese Restaurant, Crowne Plaza Dubai ♦ Not valid in conjunction with Privilege Club Benefits

9. Additional Benefits: Each member will receive one (1) set of the following certificates, for use at Crowne Plaza Dubai Deira, terms & conditions as printed on each certificate:

a. 1 x AED 100 Cash Certificate (Transferable): One (1) Cash Certificate to the value of one hundred Dirhams (AED 100), for full or part payment of food and beverage • Valid at Spice Island, Sails or Harry’s Place only
b. 1 x Buy One Get One Free Main Course Certificate (Transferable): One (1) certificate to enjoy one complimentary main course when a main course of equal or greater value is purchased ♦ Valid for main course at Sails or Harry’s Place only ♦ Not valid in conjunction with Privilege Club Benefits

10. Referral Card Incentive (Non-transferable): Upon submission of the names of a minimum of five friends or colleagues to be solicited for potential membership, Member shall receive, for each such friend or colleague who purchases a membership, one (1) complimentary lunch buffet for two (2) people.
Conditions: Complimentary Lunch does not include beverages • A maximum of two (2) certificates per Member per membership term •Valid at Al Dana Restaurant only

11. Renewal Benefit (Non-Transferable):
a. Member shall receive one (1) certificate for four (4) complimentary main courses on the purchase of four (4) main courses.
Conditions: Subject to a minimum of eight (8) people per bill per table • Valid at Oscar’s Vine Society, Sakura Japanese Restaurant and Al Tannour Lebanese Restaurant.
b. Member shall receive one (1) complimentary Spouse Membership Card. Spouse Members receive the same Benefits as Members but excluding any and all certificates i.e. valid only for Member Benefits associated directly with the membership card. With the exception of countries where it is customary for spouses not to take on the same family name, Spouse Members must have the same family name as the Member.

12. Spouse Membership (Non-Transferable): A new member will have the option to purchase one (1) “Spouse Membership”. Spouse Members receive the same Benefits as Members but excluding any and all certificates i.e. valid only for Member Benefits associated directly with the membership card. With the exception of countries where it is customary for spouses not to take on the same family name, Spouse Members must have the same family name as the Member.

TERMS & CONDITIONS

(i) Acceptance: Use of the membership card constitutes acceptance of the terms and conditions listed herein.
(ii) Membership Card: The membership card is the property of the issuing agent and must be returned upon request; valid until the expiry date featured on the membership card, which shall be one year after initial purchase date; has no cash value and does not guarantee any dining reservation.
(iii) Membership Benefit Conditions: All benefits are subject to availability; valid seven days a week, unless otherwise specified, excluding Black Out Dates below; valid until the expiry date featured on the membership card and may not be used in conjunction with any other discount or promotional offer. Membership discounts exclude applicable taxes, service charges and gratuities.
(iv) Black Out Dates: All benefits shall not be valid on New Year’s Eve. All room benefits/certificates shall not be valid during the Hajj season in participating hotels in Jeddah, Madinah and Makkah.
(v) Transferable and Non-Transferable Benefits:
A. Transferable: Benefits may be used by the Member or by a Member’s guest. The Member/ Membership Card need not be present at time of guests’ use of the benefit.
B. Non-Transferable: Benefits may be used only by the Member and upon presentation of their valid Membership Card. Proof of identification may be required by Hotel.
(vi) Certificates: Only one (1) set of certificates per Member per membership term. Hotels must be notified of the intended use of certificates at the time of advance reservation. Certificates are valid seven (7) days a week , unless otherwise stated, up to the expiration date printed on said certificates and such validity will not be extended; may not be used in conjunction with any other discount or promotional offer; and have no cash value. Certificates cannot be resold once issued to a Member. Cash Certificates: Exclude applicable taxes, service charges and gratuities.
(vii) Modification (Hotel/Restaurant & Benefit Changes): At the time of going to print, all hotels detailed in the membership collateral are participating hotels within the membership program. Participating hotels/restaurants may cease to honor benefits without prior notice. Benefits may also be subject to change without prior notice. Wherever possible, Members will be kept updated on all such modifications. Members can also verify restaurant participation & benefits by calling Customer Service. Membership Program marketing agent declines any responsibility for any such modification.
(viii) Currency Exchange: All amounts listed in US$ may be charged/calculated in local currency using current rates of exchange.
(ix) Lost/Stolen Membership Materials: All lost or stolen certificates will not be replaced. Lost or stolen membership cards must be reported to Customer Service. A processing fee of US$ 20.00 will be charged for each replacement membership card, which will be issued with the same expiration date as the previously issued card.
(x) Cancellations: Cancellation of Membership will be honored up to ten (10) days from the date of issue, but no refund will be issued until the membership card and all certificates have been returned unused to a Customer Service Office. Refund amount will be excluding shipping & handling charges.
(xi) Limitation of Liability: In no event shall the owners, operators, franchisors or licensors of any hotel that may accept the benefits of membership herein, or any of their affiliated or subsidiary companies, or their directors, agents, managers, or employees, or the proprietor or the marketing agent of the Membership Program (hereinafter collectively “Protected Parties”) be liable for any indirect, special or consequential damages; and without limiting the generality thereof, including any loss, cost or damage to, or suffered by, the Member or others, arising from defects, negligence, delays, failure of performance or non-performance, including all claims, demands, obligations, liabilities, indebtedness, breaches of contract, breaches of duty or of any relationship, liability for acts, omissions, misfeasance, malfeasance, damages of every type, nature or kind suffered by Members or others, resulting from the action, or inaction of the hotel or its agents or employees in connection with the Benefits provided to Member herein. In the event of a breach of any of the provisions hereof by any Protected Party, the extent of any liability of any such Protected Party shall be limited to the amounts paid by Member as a subscription for membership in the marketing program.
